60-4501: Authority to bring certain civil actions
against firearms or ammunition manufacturers reserved to state; exception for
breach of contract or warranty.
(a) The authority to bring civil suit and right to recover
against any firearms or ammunition manufacturer or federally licensed firearms
or ammunition dealer, by or on behalf of the state or any political subdivision
of the state, for damages, abatement of nuisance or injunctive relief arising
from or relating to the lawful design, manufacture, marketing or sale of
firearms or ammunition to the public shall be reserved exclusively to the
state.
(b) Nothing in this act shall prohibit a political subdivision from bringing
an action against a firearms or ammunition manufacturer or federally licensed
firearms or ammunition dealer for breach of contract, for breach of implied or
express warranty or for damages caused to the employees or agents of such
political subdivision by defects in firearms or ammunition purchased or used by
such political subdivision.
(c) The provisions of this act shall apply to any action brought on or after
January 24, 2001.
