Statute 28-1008: Unlawful acts; penalty; forfeiture of office.
Any officer, deputy, assistant or clerk mentioned in this act or whose
salary or compensation is herein provided for or authorized, who shall ask
or receive any fee or reward in money or its equivalent not authorized by
this act or the laws of this state, or who shall fail to make out and file
any report herein provided for, or who shall fail to pay to the county
treasurer any fees or income collected by him in the time and manner
prescribed by this act, or who shall fail, neglect or refuse to perform any
duty enjoined upon him by this act, shall for each offense be adjudged
guilty of a misdemeanor and fined in any sum not exceeding three hundred
dollars ($300) or confined in the county jail for not to exceed one (1)
year or shall receive a sentence of both such fine and imprisonment. And
such failure to perform any of the duties prescribed by this act shall be a
forfeiture of office and upon the judgment of any court of competent
jurisdiction in a civil action that such officer, deputy, assistant or
clerk has forfeited such office, he shall stand suspended during any appeal
therefrom. Except the fees of the county attorney in civil and criminal
proceedings under the laws relating to intoxicating liquors and gambling
and otherwise provided by law.
